1. ELIGIBILITY: NO PURCHASE NECESSARY. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. Open only to legal U.S. residents 18 years of age or older. Void where prohibited or restricted by law, regulation, rule or otherwise. Subject to all applicable federal and state laws and regulations. Contest begins at 12:01 a.m. EST, August 20, 2009 and ends at 11:59 p.m. EST on October 31, 2009. Claim and redemption date for the prize ends November 15, 2009. If prize is not claimed by November 15, 2009, prize will be awarded to the runner up in accordance with Section 5 below.
2. TO ENTER: Submit a video at sensiscondoms.com to the contest page. No automatic, programmed, robotic or similar means of entry are permitted, and individuals engaging in such practices will be disqualified.
Upon submission, all entries become the exclusive property of Grove Medical LLC. ("Sponsor"), no entries will be acknowledged or returned.
Contest Overview: The Sensis™ Quikstrip $5,000 Challenge invites eligible participants to submit videos through the methods provided on the contest submission page at sensiscondoms.com. Video submissions should convey the spirit of the Sensis™ Condom's Quikstrip functionality and consumer benefits. All submissions will be evaluated for appropriateness and then made available for viewing to the public on sensiscondoms.com and in any broadcasting opportunity or used for any marketing purpose the company deems appropriate.
No contestant submission will be accepted that contain vulgar or profane language, nudity or pornographic content and determination of such content in this regard shall be at the sole and exclusive discretion of Grove Medical LLC.
Entries not satisfying all the requirements of these Official Rules will be automatically disqualified. In the event that any legal or regulatory authority challenges the Contest, Sponsor reserve the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, Sponsor shall have no liability to any entrants who are disqualified due to such an action.
3. GRAND PRIZE: One Grand Prize winner will receive $5,000 cash and a "one year's supply" of Sensis Condoms with Quikstrips. The one-year's supply includes a bulk package of 365 individually Thin or Dot Ribbed foiled condoms.
RUNNERS UP PRIZE: The top 9 contestants (following the Grand Prize winner) will each receive "one-year's supply" of Sensis Condoms. The one years supply includes a bulk package of 365 individually foiled Thin or Dot Ribbed condoms.
Estimated retail value for Grand Prize Winner: $5,292. Total estimated retail value of all Prizes: $7920.00. All federal, state and local laws and regulations apply.
4. PRIZE WINNER SELECTION:
The video entries with the top 15 scores at the end of the contest, determined by multiplying the number of video ratings by the final "star" or "heart" rating at the end of the contest by the total number of video views on sensiscondoms.com and on the Sensis YouTube channel (http://www.youtube.com/user/SensisCondoms), will determine the top 15 entries. The team of Sensis™ Quikstrip $5,000 Challenge judges will then choose the Grand Prize winner and the Runners Up winners from the Top 15 entries. Judges ruling is final. The Winner will be notified by email at the email address they submit at time of entry. The Prize must be claimed by the potential winner on or before November 15, 2009. The potential Grand Prize winner will be notified of his/her potential winner status as described in Section 6 and will be required to comply with these Official Rules including, without limitation, the Affidavit and Release requirements set forth in Section 6 below.
5. RUNNER UP SELECTION: If potential "Grand Prize" prize winner does not claim prize by November 15, 2009 or if he/she is determined not to be eligible or the Official winner, the unclaimed Prize will be awarded to one of the Runner Up winners. On November 15th 2009 if the Grand Prize winner has not claimed their prize, the Runner Up winner as selected by the Sensis™ Quikstrip $5,000 Challenge judges will be awarded the Grand Prize. The Runner Up winner will be notified on November 16th 2009 and has until November 30th 2009 to claim the Grand prize. The potential Runner Up winner will be notified of his/her potential winner status as described in Section 6 and will be required to comply with these Official Rules including, without limitation, the Affidavit and Release requirements set forth in Section 6 below.
6. By participating, entrants agree to be bound by these Official Rules. Each Winner will be notified by email and will be required to execute an Affidavit of Eligibility, Liability Release and/or Publicity Release (where legal) with a valid Notary Public. to be returned within five (5) days of notification. In the event of non-compliance with these requirements (including execution of the Affidavit of Eligibility, Liability Release and/or a Publicity Release) or if Prize notification/Prize is returned as undeliverable, Prize will be forfeited.
7. Taxes on all Prizes are solely the responsibility of each Winner. No Prize transfer. Prizes are nontransferable, and no cash or other substitutions will be offered except at the sole discretion of Sponsor.
8. GENERAL CONDITIONS:
a) Only those entrants who comply with these Official Rules will be eligible to win. Neither Sponsor nor any of their agencies are responsible for any telephone, technical, network, electronic, computer, hardware or software failures, malfunctions, or disconnects of any kind, or misdirected, illegible, incomplete, stolen or garbled, fragmented, or delayed Internet/email computer transmissions or network/ISP/website/or internet accessibility; or for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible, postage due entries/mail. Sponsor is not responsible or liable for, and will deem ineligible, misdirected or delayed written and/or phone notification or participant's failure to follow these Official Rules. Sponsor reserves the right to disqualify any entrants due to technical malfunctions or contest tampering. Only the advertised number of prizes is available to be won in the Contest. Sponsor reserves the right to cancel Contest at anytime for technical reasons, contest tampering and/or other technical related issues.
b)b)ALL PARTIES HERETO SPECIFICALLY WAIVE THE RIGHT TO A JURY TRIAL FOR ALL MATTERS FOR WHICH A RIGHT TO JURY EXISTS.
c) ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR (S) RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of this Contest; to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods.
If, for any reason, the Contest is not capable of running as planned by reason of tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend this Contest for any drawing(s) and select the Grand Prize Winners for that drawing prior to the action taken.
d) Employees of Sponsor, their respective parent or any of parent's affiliate companies, subsidiaries, agents, distributors/ wholesalers, retailers (including staff) and their advertising and promotional agencies, and the employees/staff and the immediate families of each are not eligible to enter or win.
e) By entering, entrant releases Sponsor and their respective parents and affiliated companies, subsidiaries, retailers, distributors/wholesalers, and the directors, officers, employees and agencies of any of the above organizations from any and all liability whatsoever, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death, which may occur in connection with, preparation for, or participation in Contest, or possession, acceptance and/or use or misuse of prize or participation in any Contest-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. By accepting any Prize, all winners consent to the use of their names and likeness for advertising and trade purposes without additional compensation, except where prohibited by law. Sponsor are not responsible if Contest cannot take place or if prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. Entrants who do not comply with these Official Rules, or attempt to interfere with this Contest in any way shall be disqualified.
e) In any matter of litigation, arbitration or mediation, the parties hereby agree that the calculation for damages to a contestant will be difficult if not impossible to determine and therefore all liability direct or indirect, consequential, punitive or of any nature or type is limited to the costs of the production of the contest submission or $500.00, which ever is less.
f) Upon submission of each contestant's submission, such submission becomes the sole and exclusive property of Grove Medical LLC and by submission each contestant and all parties related to said contestant and all agents of said contestants and all individuals depicted within said submission have agreed to the submission and its content and hereby waive all right, title and interest to the submission for any purposes, including but not limited to copying, advertising, copyrighting content thereof.
g) This Contest shall be governed by and interpreted under the laws of the State of Florida, U.S.A. without regard to its conflicts of law provisions. All entrants to this Contest agree that all disputes arising out of or relating in any way to this Contest shall be litigated only in courts sitting in Dade County, Florida, U.S.A.
9. WHO WON: The Winners' names in the Sensis Quikstrip $5,000 Challenge will be posted on the sensiscondoms.com contest web page on October 31, 2009. |
